Acceptable Use Policy

Draft — pending counsel. This Acceptable Use Policy is a working draft and is not yet legally binding. It is published for internal review and will take effect once reviewed and approved by counsel. Provisions, defined terms, and citations to Indian regulations are subject to change.
This Acceptable Use Policy (the “AUP”) governs how you may use Vanie AIand the AI voice-agent, calling, text-to-speech, speech-to-text, and related services (the “Services”). It supplements, and is incorporated into, our Terms of Service. By using the Services you agree to use them lawfully, in good faith, and in compliance with this AUP and all applicable Indian and local laws. We may suspend or terminate access for violations.
1. Prohibited content & conduct
You may not use the Services to create, transmit, store, or facilitate any content or conduct that is unlawful, harmful, or abusive. This includes, without limitation:
- Content that is illegal under Indian law or the law of the recipient’s jurisdiction.
- Child sexual abuse material, content sexualising minors, or any non-consensual intimate content.
- Threats, harassment, stalking, doxxing, or incitement to violence or self-harm.
- Hate speech or content promoting discrimination on the basis of religion, caste, gender, sexual orientation, disability, or ethnicity.
- Malware, ransomware, phishing kits, or instructions facilitating cyber-attacks.
- Synthetic audio or voice impersonation of any person created without that person’s clear, documented consent.
- Content that infringes intellectual property, publicity, or privacy rights of others.
- Disinformation, deepfakes, or synthetic media designed to deceive about identity, authority, or facts.
2. Telemarketing & calling compliance (India)
If you use the Services to place outbound calls, send voice broadcasts, or run conversational voice agents to Indian numbers, you are a sender under the TRAI framework and must comply fully with it. You are solely responsible for the lawfulness of your campaigns.
- TRAI / DLT registration. Register as a sender, register your headers and consent-based templates, and route commercial communications only through a DLT-registered (TCCCPR-compliant) path. Unregistered or scrubbed-header traffic is prohibited.
- NCPR / DND scrubbing. Scrub every calling list against the National Customer Preference Register (NCPR / DND) before dialling. Do not call subscribers who have registered Do-Not-Disturb preferences unless you hold valid, provable consent.
- Calling window. Place promotional and telemarketing calls only between 9:00 AM and 9:00 PM local time of the recipient. No calls outside this window.
- Mandatory disclosure. At the start of every call, clearly identify yourself and the business on whose behalf the call is made, and disclose that the caller is an AI voice agent. Provide a clear, immediate way for the recipient to opt out.
- Recording preamble & consent. If a call is recorded, play a recording-disclosure preamble before recording begins and obtain consent where required. Retain consent and recording logs per our retention policy and applicable law.
- Consent & honouring opt-outs. Maintain auditable proof of consent for each contacted number and process opt-out / unsubscribe requests promptly. Do not re-add opted-out recipients to campaigns.
These obligations apply in addition to the Telecom Commercial Communications Customer Preference Regulations and any directions issued by TRAI or the relevant access provider. Cross-border calling must also respect the destination country’s telemarketing and consent rules.
3. No fraud, impersonation, or spam
The Services may not be used to deceive, defraud, or harass. You must not:
- Impersonate any individual, business, government body, bank, or official without authorisation.
- Run financial scams, phishing, vishing, KYC fraud, lottery/prize fraud, loan or investment fraud, or social-engineering attacks.
- Spoof caller IDs or sender headers to disguise origin, or use synthetic voices to extract money, credentials, or OTPs.
- Send unsolicited bulk communications (spam) by voice, SMS, or messaging channels.
- Misrepresent that a human is on the line when the caller is an AI agent.
4. No scraping, reverse engineering, or platform abuse
You must not interfere with or attempt to circumvent the integrity of the Services. Specifically, you may not:
- Scrape, harvest, crawl, or bulk-extract data, voices, models, or content from the Services except through documented APIs within their stated limits.
- Reverse engineer, decompile, disassemble, or attempt to derive source code, model weights, or underlying algorithms.
- Probe, scan, or test the vulnerability of our systems, or breach or circumvent authentication, rate limits, or quota controls.
- Resell, sublicense, or white-label the Services without a written agreement permitting it.
- Use automated means to create accounts, evade billing, or abuse trial credits.
5. Rate & volume limits
Usage is subject to per-plan rate limits, concurrency caps, and volume quotas (requests per minute, concurrent calls, synthesis minutes, and API throughput). These limits protect platform stability and downstream telecom and model partners.
- Do not exceed published limits or distribute traffic across accounts to evade them.
- Sustained bursts, denial-of-service-like patterns, or abusive retry loops may be throttled or blocked automatically.
- Need higher limits? Request a quota increase through your account rather than working around the controls.
6. Consequences of violation
We may, at our discretion and without prior notice where the situation warrants, take any of the following actions in response to a violation of this AUP:
- Throttle, rate-limit, or temporarily suspend affected features or your account.
- Remove or disable offending content, voices, or campaigns.
- Suspend or terminate your account and revoke API credentials.
- Withhold or reverse credits associated with abusive usage.
- Report unlawful activity to TRAI, access providers, law enforcement, or other competent authorities, and cooperate with their investigations.
The severity of the action will reflect the severity and recurrence of the violation. Suspension does not relieve you of accrued obligations under the Terms of Service.
7. Reporting abuse
If you believe the Services are being used in violation of this AUP — for example, fraudulent calls, voice impersonation without consent, or spam — please report it so we can investigate.
- Email contact@vanieai.com with the phone number, account, or content involved and the date and time of the incident.
- Include any recordings, screenshots, or message IDs that help us trace the activity.
- We aim to acknowledge credible abuse reports promptly and act on confirmed violations.
